Spalatum Terms and Conditions

SPALATUM, obrt za prijevoz i usluge (Spalatum Transfers) made the following terms and conditions defining the rights and the obligations between the company SPALATUM, obrt za prijevoz i usluge and users of transportation services provided by the company SPALATUM, obrt za prijevoz i usluge. Spalatum Transfers is the trading name of the company SPALATUM, obrt za prijevoz i usluge.

SPALATUM, obrt za prijevoz i usluge is licensed for transportation of passengers and in this text is a service provider (“we”, “us” and “our” in this text refers to SPALATUM, obrt za prijevoz i usluge).

The “client” or “customer” is a person who uses our transportation service, website, and booking system.

You acknowledge that you have the capacity to enter into legally binding contracts on behalf of yourself and/or any other Passengers by filling out the Booking Form. The Booking form shall be considered an integral and essential component of these Terms and Conditions.

If you refuse to be bound by these Terms and Conditions and to adhere to them, you cannot order any Service from us, so contract won’t be signed. The Company will not knowingly perform any Service for a Customer that has not agreed to these Terms and Conditions.

In case you consider any provision or statement on website unclear or if you are uncertain whether it applies to you, we strongly encourage you to contact us for additional clarification. Failure to do so shall absolve us of any responsibility to you, whether listed or implied in these Terms and Conditions or otherwise.

Changes to these Terms and Conditions will be published in the form of an announcement on our websites.

Transfers

Transfer is transportation of passengers from a location of pickup to the drop off location, and is driven in accordance with the reservation. That reservation has been made by the customer.

Prices of transfers are based upon the distance between the initial and the destination, number of passengers, type of vehicle (standard car, standard van, luxury car, luxury van, minibus, boat) and market conditions.

Prices for individual routes are available on our website. If the website does not have the route you wish to book transfer for, then the customer is to email a request to info@spalatumtransfers.com and we will provide an offer for that transfer.

Passengers will be met at the agreed pickup location by our professional driver. The driver will drive the passenger to the agreed drop-off address or to the nearest possible location accessible by vehicle.

The Customer is required to sign a transfer agreement which is a legal obligation in Croatia and transfer prices are per vehicle and not per person.

Luggage

Personal luggage is included in the price. Standard Luggage is considered one large suitcase and one hand luggage per person. If the quantity of luggage is larger than standard luggage, it is necessary to inform us prior to the transfer so we can send a vehicle of suitable size for that transfer.

Spalatum Transfers does not accept responsibility for missing items or any damage to fragile items contained in the luggage of clients.

We are not obligated to transport any extra luggage that was not declared in a reservation if there is not enough room in the vehicle.

Spalatum Transfers does not accept responsibility for the content of luggage. We nor any of our contracted or sub-contracted drivers will accept responsibility for luggage loss or damage.

We and/or our contracted or sub-contracted drivers have the right to refuse any client or to make the journey due to the client having excess luggage which would result in the vehicle being unsafe whilst in motion.

Online Booking Procedure

A person who wants to make a reservation must be over 18 and must have a valid credit / debit card or Paypal account.

The customer is to select the route of their choice and then proceed in filling out the Spalatum Transfers booking form on the Spalatum Transfers website.

A customer who enters the data is responsible for its validity. Spalatum Transfers does not accept responsibility for wrongly entered or untrue information. A person who enters the data for the group accepts the terms in the name of the whole group, and is responsible for the whole group.

We do not have to accept your reservation. If the reservation is accepted, the customer will receive an e-mail confirmation. If a reservation is not accepted and the payment is completed, the amount paid is returned in full and in the shortest possible time.

It is the customer’s responsibility to review the transfer reservation and immediately report any errors or faults to info@spalatumtransfers.com.

All personal information that customers enter during the reservation process is secure and accessible only to authorized employees of Octopus Travel d.o.o.

SPALATUM, obrt za prijevoz i usluge is committed to safeguarding its customers’ privacy and security of personal information. We do not sell, share or otherwise distribute our client’s personal information.

Methods of Payment

SPALATUM, obrt za prijevoz i usluge offer 1 method of payment to its customers using its website. We take a 30% deposit for the transfer upon making the booking and the balance is paid to the driver in cash at the end of the transfer.

The deposit payment can be made by using Paypal, whereby payment can be made using your Paypal account or credit card. Alternatively, if you want to make payment using a credit card not using the Paypal gateway we offer MY POS which accepts all major credit / debit cards (Visa,Visa Electron V PAY, MasterCard,Maestro, American Express,Union Pay,JCB,Bancontact, I Deal Apple Pay, Google Pay, Pay) via their secure connection.

Secure Internet Payments

myPOS is fully compliant with the European Banking Authority’s Guidelines on the security of Internet payments. We are also authorised and regulated by the FCA as an electronic money institution, the Payment Service Regulation of 2017 and the Electronic Money Regulations of 2011.

Data Protection

myPOS is duly registered as a personal data administrator with the Commission for Personal Data Protection under number 0050022 and all customer data is collected, transferred and maintained in accordance with the principles incorporated within the EC Directive 95/46 on the protection of personal data and with the Data Protection Act, 2002 of the Laws of Bulgaria (and any amendment thereof).

Secure infrastructure

The personal data regarding the merchant that is provided by the merchant as well as by third parties such as state and international authorities, which have competence in the prevention of fraud, is preserved in electronic form on servers, collocated in TIER 4 data centres located in Class A jurisdictions in Europe with the highest level of communication coverage, security and control of access.

Our advanced systems offer real-time monitoring and protection from suspicious traffic and behaviour. А dedicated team of information security specialists is closely working with the engineering teams to ensure that our applications, dataflow and infrastructure remain secure at all levels.

Licenses and Certifications

myPOS is PCI DSS certified and goes through an annual audit to maintain this status. The PCI Data Security Standard (DSS) is created by Visa, MasterCard and other well-respected debit/credit card providers. It is entirely based on their years-long experience in dealing with countless security threats while securing their customers’ data.

myPOS is a UK licensed and regulated Electronic Money Institution. As such, we follow very strict customer funds safeguarding procedures. We do not re-invest our customers’ funds and we are required by law to keep our finances separate. Therefore, your money is better protected than in standard bank deposits.

Fraud Prevention Mechanisms

Real-time monitoring and protection against suspicious transactions, data traffic and behaviour are constantly working in the background to ensure smooth operations. The two-factor transaction authorisation and limits are also available to every myPOS merchant.

Funds Protection

myPOS merchants enjoy 24/7 money monitoring, automatic fraud prevention, real-time notifications, transaction limits and webhooks for specific events.

All monetary operations require authorisation. You will get instant notifications straight to your mobile device every time. Notifications are a great way to make it harder for any fraudulent activity to go unnoticed. This gives you peace of mind that you are the only one who has control over your account, funds, POS devices and debit card.

3D Secure

3D Secure provides additional assurance by verifying you when making purchases on the Internet. As a myPOS user, the service is automatically enabled on your myPOS Business debit card. Depending on the card you use, you will be redirected either to a Verified by Visa page or a MasterCard SecureCode page to enter the authentication code (OTP) that we will send to your phone. This measure provides extra protection against online fraud.

Cancellation Policy

Bookings inside 24 hours are not possible before (without) checking availability of vehicle (24/7 support phone is +385 99 365 0024)

Cancellations for smaller vehicles (sedan, van) inside 24 hours will be charged in full amount (100%). Cancellations outside 24 hours are free of charge.

After 15 minutes of waiting (delay from pick up time) vehicle is free to leave location without clients

On islands: prices are including transfer from airport to ferry port and transfer to address on island. Vehicle is not going on ferry with passengers

Force Majeure

The Company shall be considered released from its obligations as per these Terms and Conditions if the Company or any of its representatives and contracted partners are unable to fulfill their obligations as a consequence of force majeure arising after the ordering of the Service.

Force majeure refers to emergency events that could neither be predicted by the Company nor prevented by reasonable measures.

Events arising from force majeure are those for which the Company is not responsible and/or cannot influence them, but they considerably affect the provision of the Service. Such events are, for example, an earthquake, a flood, a fire, strikes, government regulations or orders of state bodies, military actions of any character etc.

Safety Issues

All vehicles that are used for transfers are properly inspected and insured.

Passengers insurance is included in the price of the transfer.

A passenger under the influence of alcohol, drugs or other controlled substances won’t be allowed to enter a vehicle and will not be entitled to a refund of the amount paid.

A passenger whose behavior endangers the safety of driver, other passengers or other participants in traffic will be removed from the vehicle, and reported to local police department.

Smoking, consuming food and beverages, alcohol or drugs in the vehicle is strictly prohibited. Exceptions to this policy are water and soft drinks in bottles. Everything else must be approved by the driver.

Collection and Protection of Personal Data

Your privacy is our priority. We are committed to protecting your personal information. Your name and address information is used solely to process bookings. This information will never be sold, given, rented or traded to others for purposes other than order fulfillment. Data is available only to authorized company representatives. All our employees and business partners are responsible for respecting the principle of protection of privacy under the GPDR. Refer to our privacy policy for more information.
